Rubbish Removal Barnet Terms and Conditions of Service

These Terms and Conditions set out the basis on which Rubbish Removal Barnet provides rubbish removal, waste collection, clearance and related services to residential and commercial customers in our service area. By making a booking, confirming a quotation or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business or organisation requesting rubbish removal or waste collection services from Rubbish Removal Barnet.

Company, we, us, our means Rubbish Removal Barnet, the provider of rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal work carried out by the Company for the Customer.

Waste means any materials, items, refuse, junk, rubbish or other substances presented by the Customer for removal under the Services, excluding any prohibited or hazardous items as detailed in these Terms and Conditions.

Quotation means a price estimate issued by the Company for the provision of the Services, whether given verbally, in writing, by email, by message or through an online booking form.

2. Scope of Services

The Company provides rubbish removal and waste collection services for domestic and commercial premises, including but not limited to household clearances, garden waste removal, builder's waste collection, office clearances and general rubbish removal.

Unless expressly agreed otherwise in writing, the Services are limited to the removal of loose items of Waste which are reasonably accessible to our operatives. The Company is not obliged to dismantle fixtures or fittings, disconnect utilities, or perform building or repair works as part of the rubbish removal service.

The Company reserves the right to refuse to remove any item or material which, in the judgement of our operatives, is unsafe to handle, is prohibited, or may cause damage, contamination or breach of any relevant legislation or regulations.

3. Booking Process

Customers may request a rubbish removal or waste collection booking by telephone, email, online enquiry form or other communication method accepted by the Company. All bookings are subject to availability and acceptance by the Company.

When making a booking, the Customer must provide accurate and complete information, including the type and approximate volume or weight of Waste, access details, property type, any parking restrictions and any factors which may affect the delivery of the Services.

The Company may provide a Quotation based on the information supplied at the time of booking. This Quotation may be given as a fixed price or as an estimated price range based on the likely volume and nature of Waste to be collected.

Any Quotation is given on the assumption that the description of the Waste and access conditions provided by the Customer are accurate. The Company reserves the right to amend the price if the actual Waste or site conditions differ from those described at the time of booking.

A booking is deemed confirmed when the Customer accepts the Quotation and the Company acknowledges the booking, which may include providing a booking reference, confirmation message, or agreeing a collection date and time window.

4. Access, Parking and Customer Obligations

The Customer must ensure that the Company has safe, adequate and lawful access to the premises at the agreed collection time. This includes ensuring that any gates, doors or access routes are unlocked and that there are no obstructions preventing our operatives or vehicles from reaching the Waste.

The Customer is responsible for arranging and paying for any necessary parking, permits or access permissions required for our vehicles. Any parking charges, penalty notices or additional costs incurred due to insufficient or illegal parking arrangements may be charged to the Customer.

The Customer must ensure that the Waste to be collected is clearly identified and separated from items that are not intended for removal. The Company accepts no responsibility for removing items which are not clearly designated as Waste for collection.

Where the Customer or a representative is not present at the property during collection, the Customer must provide clear instructions and authorisation for access and identification of the Waste. In such circumstances, the Customer accepts that the judgement of our operatives as to which items form part of the Waste is final.

5. Pricing and Quotations

Prices for our rubbish removal and waste collection services may be based on the volume of Waste, type and weight of materials, labour time, access conditions, location within our service area, and disposal or recycling charges.

Any Quotation provided prior to the arrival of our operatives is an estimate only, unless expressly stated in writing as a fixed price. The final price will be confirmed on site after inspection of the Waste and site conditions.

If the Customer declines to proceed after the on-site price is confirmed, the Company reserves the right to charge a call-out or attendance fee to cover time and travel costs. Any such charge will be disclosed to the Customer at the time of booking or prior to attendance.

All prices are quoted in pounds sterling and, unless expressly stated otherwise, are exclusive of any applicable taxes or charges that may be applied under UK law.

6. Payments

Payment for the Services is due on completion of the work on the day of collection, unless alternative payment terms have been agreed in advance in writing.

The Company may accept payment by cash, debit card, credit card or bank transfer, subject to the payment methods available at the time of service. The Customer is responsible for ensuring that they have an accepted method of payment available when the Services are provided.

For business and commercial Customers, the Company may, at its discretion, agree to invoice the Customer with payment due within a specified period. Late payment may result in the suspension of further services and may incur interest or administration fees as permitted by law.

The Company retains ownership of any Waste collected until full payment for the Services has been received. The Company reserves the right to recover any unpaid sums through legal action, and the Customer will be liable for any reasonable costs of recovery.

7. Cancellations and Rescheduling

The Customer may cancel or reschedule a booking by contacting the Company directly. To avoid cancellation charges, notice should be given as early as possible and no later than 24 hours before the scheduled collection time.

If the Customer cancels within 24 hours of the scheduled collection time, or fails to provide access to the premises at the agreed time, the Company may charge a reasonable cancellation or wasted journey fee to cover time, labour and travel costs.

If the Company needs to cancel or reschedule a booking due to vehicle breakdown, staff shortages, extreme weather, safety concerns or other circumstances beyond its reasonable control, the Company will notify the Customer as soon as practicable and offer an alternative collection date. The Company will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any payment already received for the affected booking.

8. Waste Types and Prohibited Items

The Company will collect and dispose of general household rubbish, furniture, appliances, garden waste, non-hazardous construction waste and similar materials in line with applicable regulations and our waste carrier obligations.

The Customer must inform the Company in advance if any Waste to be removed includes heavy items, oversized objects, or materials that may require special handling or additional labour.

The Company will not collect certain hazardous or prohibited materials, including but not limited to asbestos, clinical or medical waste, biological waste, pressurised containers, explosives, chemicals, solvents, oils, fuels, paint in liquid form, car batteries, gas bottles, and any other substances classified as hazardous or controlled waste unless expressly agreed in writing and properly arranged in accordance with law.

If prohibited or hazardous items are discovered during collection, the Company may refuse to remove them and may either adjust the Quotation to reflect safe handling requirements or terminate the Services. Any additional costs incurred in dealing with such materials, including site safety measures or specialist disposal, may be charged to the Customer.

9. Compliance with Waste Regulations

The Company operates as a waste carrier in accordance with applicable UK laws and regulations. All rubbish removal and waste collection work is carried out with the intention of ensuring that Waste is transported, recycled and disposed of lawfully and responsibly.

The Customer warrants that they have the right to authorise the removal of the Waste and that the Waste presented does not breach any applicable waste management or environmental regulations.

Once Waste has been collected and payment has been made, the Company assumes responsibility for the lawful transportation and disposal of that Waste. The Company will use authorised facilities for recycling, recovery and disposal wherever possible and in accordance with regulatory requirements.

The Customer acknowledges that they remain responsible for any Waste not actually taken by the Company and for any items left on site that were not clearly designated for removal.

10. Liability and Limitations

The Company will take reasonable care and skill in providing the Services. However, the Customer accepts that some minor scuffs, marks or disturbance to areas near the Waste may be unavoidable when removing heavy or bulky items.

The Customer is responsible for protecting any delicate surfaces, flooring, fixtures or fittings that may be at risk of damage during rubbish removal. The Company recommends the Customer moves valuable or fragile items away from the work area in advance of the collection.

The Company shall not be liable for any indirect or consequential loss, loss of profits, loss of business, or loss of opportunity arising out of or in connection with the Services, whether in contract, tort or otherwise.

Nothing in these Terms and Conditions limits or excludes the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law.

Subject to the above, the Company's total liability to the Customer for any loss or damage arising from or in connection with the Services shall not exceed the total price paid or payable by the Customer for the relevant booking.

11. Customer Property and Title to Waste

The Customer is responsible for ensuring that no personal belongings or items of value are mixed with the Waste. Once removed, Waste becomes the property of the Company and cannot be returned.

If the Customer believes that an item has been removed in error, they must notify the Company as soon as possible. While the Company will make reasonable efforts to investigate, it cannot guarantee recovery of any such item and accepts no liability for any loss of or damage to property that was not clearly excluded from the Waste.

12. Health and Safety

The Company is committed to operating safely and in compliance with health and safety legislation. Our operatives may refuse to perform any task that, in their professional judgement, would pose an unacceptable risk to their health or safety or that of others.

The Customer must not ask our operatives to perform tasks outside the agreed scope of the Services or which may put them at risk, such as climbing unsafe structures, working at undeclared heights, or moving items that exceed safe lifting limits.

13. Privacy and Data

The Company may collect and store personal data relating to the Customer for the purposes of managing bookings, providing Services, processing payments and complying with legal obligations.

The Company will take reasonable steps to protect such data and will not share personal information with third parties except as necessary to provide the Services, process payments, or where required by law or regulation.

14. Complaints

If the Customer is dissatisfied with any aspect of the rubbish removal or waste collection service, they should notify the Company as soon as reasonable after completion of the work, providing details of the issue.

The Company will investigate complaints promptly and, where appropriate, may offer a remedy such as returning to complete work, adjusting the charge, or other reasonable corrective measures. Any remedy will be offered at the Company's discretion and in line with applicable consumer rights.

15. Variations to Terms

The Company reserves the right to update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking.

Any variation to these Terms and Conditions requested by the Customer must be agreed in writing by an authorised representative of the Company.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the provision of the Services shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted but the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with any written Quotation or service confirmation issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the provision of rubbish removal and waste collection services. The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these documents.
